Switch™ Referral Terms
PLEASE READ THESE REFERRAL TERMS CAREFULLY.
1. REFERRALS
1.1. You may use the Referral Program by clicking on the “Invite & Earn” link to share a unique link or create a referral email to a friend (each of the link or referral email, a “Referral”).
1.2. Subject to your compliance with the terms of this Agreement, as you meet the Referral Program requirements described below, Switch shall credit your Switch account with referral fees (each, a “Referral Fee” and collectively, the “Referral Fees”).
2. ELIGIBILITY
2.1. You must be a registered Switch customer.
2.2. Both you and your friend must be (a) two different individuals, (b) over 18 years of age, and (c) residents of countries where Switch offers its services.
2.3. Your friend cannot be a current user of Switch or linked to any existing Switch account.
2.4. Your friend may only add credits to their Switch account using a credit card, debit card, or bank account in their own name.
2.5. Points will be given only for Successful Referrals meeting the eligibility criteria.
2.6. A “Successful Referral” is a natural person that you have referred to Switch who is not a current Switch customer or linked to any current Switch account, who creates a Switch account using your unique referral link, and adds $25 to their Switch account.
3. CREDITS
3.1. Once your friend adds their first $25 to their Switch account, they will receive an additional $10 in Switch credit in their Switch account.
3.2. For each Successful Referral, you will receive 10 points.
3.3. You will receive Referral Fees equal to $10 in Switch credit in your Switch account when you reach 10, 30, 50, and 100 points, up to a maximum of $40.
3.4. All requirements and Referral Fees are listed in US dollars.
3.5. The amount of any Referral Fees will be displayed in the Switch web app or mobile app where the respective Referral is provided. However, the actual amount of any Referral Fee may vary after verification by Switch.
3.6. Welcome offers, Referral Fees, or other credits have no cash value and can be used only in the Switch app for the purposes contemplated by the Switch Terms of Service
4. PROHIBITED USES
4.1. You may only use the Referral Program in good faith for lawful purposes. You may not:
4.1.1. Create more than one account to invite yourself;
4.1.2. Invite others that have created duplicate accounts;
4.1.3. Use alternative contact information to refer yourself or others to create duplicate accounts;
4.1.4. Invite an existing customer of Switch;
4.1.5. Invite fictitious people;
4.1.6. Use the Referral Program for any kind of commercial activity, including advertising;
4.1.7. Post your Referral for public distribution on websites of which you are not the primary owner, on blogs, or elsewhere with the purpose of soliciting Referral Fees;
4.1.8. Engage in mass emailing, texting, or messaging people you do not know or use automated systems or bots through any channel to distribute your Referral;
4.1.9. Do anything that damages Switch’s brand, goodwill, or reputation;
4.1.10. Use the Referral Program in any way: (a) not in compliance with applicable local, national, or international law or regulations; (b) that is unlawful or fraudulent or with fraudulent purpose or effect; (c) that contravenes any other agreements we have with you, including our Terms of Service.
4.1.11. To transmit any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
4.1.12. To transmit any unsolicited or unauthorised advertising either via paid search or any other similar activity, including channels that could damage the Switch brand, goodwill, or reputation.
4.2. Any obligation not to do something also includes a corresponding obligation not to allow that thing to be done by another person or entity.
5. IDENTIFICATION DOCUMENTS
5.1. Switch may require that you provide identification documents before Switch credits your account with any Referral Fee.
5.2. Switch will not be in breach of this Agreement nor have any obligation to credit your account with a Referral Fee if you do not, in Switch’s sole and absolute discretion provide adequate identification documents after Swtich’s request.
6. DATA PROTECTION
You represent and warrant that you have obtained the express consent of the individuals whose contact information you enter into Switch or to whom you send a referral invitation.
7. ABUSE OF THE REFERRAL TERMS
7.1. Switch has the right to refuse to credit any Referral Fee to your account if, in Switch’s sole and absolute discretion, Switch suspects that you have not used the Referral Program in good faith or have breached this Agreement.
7.2. Switch will determine, in its sole and absolute discretion, whether there has been a breach of this Agreement. When there has been a breach of this Agreement, Switch may take such action as it deems appropriate, including but not limited to terminating this agreement, closing your account, and suspending the Referral Program.
8. GENERAL TERMS
8.1. Switch accepts no liability for any use of the Referral Program that does not comply with this Agreement.
8.2. Switch may revise this Agreement at any time by amending this page. Your continued use of the Referral Program after any revision shall evidence your acceptance of the Agreement in force at that time.
8.3. Switch reserves the right to:
8.3.1. Amend, alter, or change the Referral Program at any time without notice; and
8.3.2. Suspend or terminate the Referral Program at any time, without notice. If the Referral Program is terminated, Switch will not be obliged to credit any accounts which would have qualified for Referral Fees after the date of such termination.
8.3.3. Reverse any Referral Fees credited to your account or another account if there is a violation of any of the terms of this Agreement.
8.3.4. Suspend any account or reverse any Referral Fees if Switch notices any activity that Switch believes, in its sole discretion, is abusive, fraudulent, or in violation of the Switch Terms of Service or this Agreement.
8.4. This Agreement and any dispute or claim arising out of it or in connection with it, its subject matter, or its formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard for its conflicts of laws provisions, and the courts of such state shall have exclusive jurisdiction over any such dispute or claim.
