This Privacy Notice (“Notice”) is intended to inform you about the different categories of personal data collected when you (“you” or “your”) use the Switch  (operated by Quadient, Inc. and referred to as “us”, “our” or “we”) application, which can be operated via mobile application or web application (together, the “Apps”) and its related websites (“Sites”). It also describes how your personal data is used, shared, and protected. This notice also provides a contact point for users to exercise any rights associated with their personal data. We may update this Notice to address changes in the law or our App and Sites and will change the publication date if this occurs. This Notice will control over any conflicting documents.

 

Use of Cookies

 

We use cookies on various Site pages to make visiting our Site more attractive and to enable the use of certain functions. “Cookies” are text files that are stored on your computer and that allow an analysis of the use you make of the Sites. Most of the cookies we use are deleted from your hard drive at the end of the browser session (so-called session cookies). Other cookies remain on your computer and allow us to recognize your computer on your next visit (so-called persistent cookies). These cookies are used to greet you with your username and will not require you to re-enter your password or fill out forms with your data for subsequent orders. If you do not want to use cookies, do not provide consent for them or deactivate cookies in your web browser. Please be aware that disabling cookies might make it difficult to use some of the services provided in our Sites, some of them are only available with activated cookies.If you are using the mobile application, we will record a token in order to identify your device for subsequent visits. Collection of Personal Data

 

We will collect personal data for the purpose of operating the service provided by the App. These data include your postal address and, if you become a registered user, your e-mail address and a password. We will also collect the postal addresses of the persons you want to send mail to. We will record your navigation history on our Apps and Sites in order to optimize the service that we provide and for statistical purposes. We will handle these data in compliance with Your local Privacy laws. Regarding the content of the mail you will send when using our application, we will behave as your data processor. This means that we, and any sub-processor, will not access to the content unless formally instructed by you for customer service purposes.

We will use your e-mail address to send you notifications about the mail you have sent, about your payments, credit balance, usage reports and bills. Because these notifications concern your transactions, you cannot opt out of them. Your e-mail address may also be used for sending you personalized offers and our newsletter if you subscribe. You may opt-out of receiving our publications at any time.

We will not collect data other than the ones strictly necessary to provide and promote the service, and we will not use them for other purposes than the ones listed above.

 

 

Collection of Device Data

 

We will collect your device token, device type, and device version as well as browser information to help better fit content provided to you, increase device performance to reduce battery consumption, and send push notifications. We will record your IP addresses when you perform a payment to prevent fraud in your transaction and to limit the potential for unauthorized access.

 

Transfer of Personal Data

 

Your personal data may be transferred to:

  • Approved service partners processing personal data on our behalf, for instance for processing credit cards and payments, hosting and servicing our application and Sites, distributing emails, as well as providing the services and features of the application. Our service partners are certified according to PCI-DSS and ISO27001 standards.
  • Marketing providers providing research and analysis services for us, for managing our brand, and for promotions.
  • Other parties to the extent necessary to: (i) comply with a government request, a court order or applicable law; (ii) prevent illegal uses of our Sites and Apps or violations of our Sites’ and the Apps’ Terms of Use; (iii) defend ourselves against third party claims; and (iv) assist in fraud prevention or investigation.

 

Managing your personal data

 

You can request: (i) access to your personal data; (ii) correction of your personal data if it is incomplete or inaccurate; or (iii) deletion of your personal data. You can also have the right to object to the processing of your personal data on compelling legitimate grounds relating to your particular situation. Where we have obtained your consent for the processing of your personal data, you can to withdraw your consent at any time. You can also object to the processing of your personal data, including opting-out from the use of your personal data for direct marketing purposes.  Some jurisdictions give you additional rights to manage your personal data. Security

 

We use a variety of technical and organizational security measures, including encryption and authentication tools, to maintain the safety of your personal data. Your personal data is processed in secured networks and is only accessible by a limited number of persons with special access rights to these systems. Your personal data may be processed in the US.

 

 

Retention of Your Data

 

We retain your personal data for a period of three years after your last usage of the application. After this period, your personal data will be anonymized and kept only for statistical purposes. The content of the mail will be saved for a period of two months for customer service purposes, after which it will be permanently erased. You have the right to request the deletion of your personal data and of the content of the mail at any time within these periods. We will keep financial records for a period of 10 years after the related transaction as required by the relevant taxing authorities.

Use of Analytics providers

 

Our Apps and Sites use web analytics services employing so-called “cookies”, text files that are stored on your computer and that allow an analysis of your use of the Sites. The information generated by the cookie about your use of the Sites is usually transmitted and stored to an Analytics provider in the USA. These data are anonymized and then aggregated. Once anonymized, these are no longer considered as personal data. The Analytics provider will use this information on our behalf to evaluate use of the Sites, to compile reports on website activity and to provide other services related to website activity and internet usage to us.

You can prevent the storage of cookies by a corresponding setting of your browser software; however, please note that if you do this, you may not be able to use all the features of the Site to the fullest extent possible.

Your California Privacy Rights

 

This Privacy Notice for California Residents (“CCPA Notice”) supplements the information contained in the Switch (operated by Quadient, Inc. hereafter, “Quadient” or “our” or “we”) Privacy Notice (https://wpswitch.wpengine.com/privacy-policy).  This CCPA Notice applies only to Quadient’s consumer customers and other applicable persons who reside in the State of California (“Consumers” or “you” or “your”).  Quadient adopts this CCPA Notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”), and any defined terms in the CCPA shall have the same meaning when used in this CCPA Notice.

 

 

Your Rights

 

The CCPA provides California residents with certain rights regarding their personal information. This CCPA Notice describes your CCPA rights and how you may exercise them. Please note, these rights may not always apply in all cases.

 

Right to Access
You have the right to request the disclosure of certain information about our collection and/or use of your personal information over the past 12 months. Once your verifiable access request is received and verified, we will disclose to you:

  • The categories of sources for the personal information We collect about you.
  • Our business or commercial purpose for collecting that personal information.

We do not sell your personal information, and as such, we have not included a “Do Not Sell My Personal Information” link on our website. However, under the CCPA, you have the right to opt-out of the sale of your personal information by other entities you may do business with. Any practice changes will be reflected in an update to this CCPA Notice, and we will take any other necessary action to comply with applicable law.

Right to Request Deletion 
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.  A deletion request may be denied if retention of such information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Equal Services and Prices
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny your goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you with a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

 

Exercising Your Rights

 

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

In your request, you need to provide enough information that allows us to reasonably verify that you are the consumer that we collected information about.
We endeavour to respond to all verifiable consumer requests within forty-five (45) days of their receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing, and/or explain the reasons we cannot comply with a request, if applicable. Any disclosures we provide you will only cover the 12-month period preceding the verifiable consumer request’s receipt and will be in a format that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will provide you with the reason for that determination as well as a cost estimate before completing your request.
